Singer Art Garfunkel, who pleaded guilty to marijuana possession just a year and a half ago, was busted again over the weekend after a joint was allegedly found in the ashtray of his car, police in upstate New York said. The 63-year-old Garfunkel, who lives in Manhattan, was charged after being pulled over for failing to stop his car at a stop sign, the Daily Freeman of Kingston reported yesterday. Upon approaching Garfunkel's vehicle, a trooper noticed a strong odor of pot, and a subsequent search turned up the joint in the ashtray. Garfunkel was issued a ticket and is due back in Woodstock Town Court Sept. 22. In January 2004, Garfunkel was charged with marijuana possession after state police stopped his limo for speeding near Woodstock and found a small amount of pot in the singer's jacket.

Aniston shows restraint

Jennifer Aniston has filed a restraining order against David Hesterby, the man who last week broke into her Malibu home. Hesterby was arrested Thursday and is being held on $70,000 bail. A hearing is set for Sept. 14, when a judge will determine whether or not to grant the restraining order.

'Arrested' nabs Theron

Oscar winner Charlize Theron is joining Fox's ''Arrested Development" for its third season. She has signed on to guest in five episodes, playing a British woman who becomes the love interest of ''Development" star Jason Bateman. Theron, who won a best actress Oscar for her performance in ''Monster," will debut in the second ''Development" episode of the season, after its Sept. 19 premiere.
